DMCA and Copyright Policy

Hitnews respects the intellectual property rights of others and expects users of its services to do the same.

Hitnews is operated by RSP Sales Inc., 963 Street Road, Southampton, PA 18966, United States. This DMCA and Copyright Policy describes how Hitnews handles notices of alleged copyright infringement under the United States Digital Millennium Copyright Act ("DMCA"), including 17 U.S.C. Section 512.

1. Copyright and Usenet

Hitnews provides access to Usenet infrastructure and services. Content available through Usenet is generally created, posted and distributed by independent third parties.

Hitnews does not create, select or endorse third-party Usenet content merely because that content may be accessible through the Hitnews service.

Users are responsible for ensuring that their use of Usenet, including uploading, posting, downloading, copying, transmitting or distributing content, complies with applicable copyright laws and does not infringe the intellectual property rights of others.

The fact that content is technically accessible through Usenet does not mean that the content is free of copyright protection or that a user has permission to copy, download, upload, distribute or otherwise use it.

2. DMCA Notices

If you are a copyright owner, or are authorized to act on behalf of a copyright owner, and believe that copyrighted material has been infringed through the Hitnews service, you may submit a written DMCA notice to Hitnews's Designated Copyright Agent.

A DMCA notice should comply with the requirements of 17 U.S.C. Section 512(c)(3).

3. Required Information

To be effective under the DMCA, a notice of alleged copyright infringement should include substantially the following information:

A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are covered by a single notice, a representative list of those works.
Identification of the material claimed to be infringing or to be the subject of infringing activity, together with information reasonably sufficient to enable Hitnews to locate or identify the material. For Usenet material, please provide the relevant Message-ID or Message-IDs whenever available. Providing only a filename, title, search result, NZB reference or general description may not be sufficient to identify a specific Usenet article.
Information reasonably sufficient to allow Hitnews to contact you, such as your name, mailing address, telephone number and email address.
A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Incomplete notices may delay Hitnews's ability to investigate or respond.

5. Processing DMCA Notices

When Hitnews receives a valid DMCA notice, Hitnews will review the notice and, where required by applicable law, respond expeditiously to remove or disable access to material that is properly identified and within Hitnews's ability to control.

Hitnews may request additional information when a notice does not contain sufficient information to identify the relevant material or otherwise does not substantially comply with applicable DMCA requirements.

Where appropriate and required by law, Hitnews may notify the affected subscriber or account holder of the action taken.

Submission of a DMCA notice does not guarantee that particular material can be removed from Usenet globally.

6. Content Originating Outside Hitnews

Usenet is a distributed network involving numerous independent providers and servers. Hitnews may not have the technical ability or legal authority to remove material from servers operated by independent third-party Usenet providers.

Where material identified in a complaint did not originate through systems operated or controlled by Hitnews, Hitnews may be unable to remove the original material from the originating system. In such circumstances, the copyright owner may need to contact the Usenet provider from which the relevant material originated.

7. Counter Notification

If material associated with your account has been removed or access to it has been disabled as a result of a DMCA notice and you believe that the material was removed or disabled because of mistake or misidentification, you may be entitled to submit a counter notification under 17 U.S.C. Section 512(g).

A counter notification should include substantially the following information:

Your physical or electronic signature.
Identification of the material that was removed or to which access was disabled and the location at which the material appeared before it was removed or access was disabled.
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, address and telephone number.
A statement that you consent to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. Section 512(g), and that you will accept service of process from the person who submitted the original DMCA notice or that person's agent.

Counter notifications should be sent to the Designated Copyright Agent identified in Section 4.

8. Procedure Following a Counter Notification

When Hitnews receives a valid counter notification, Hitnews may provide a copy to the person who submitted the original DMCA notice.

Subject to the requirements of the DMCA, Hitnews may restore the affected material or re-enable access to it after the statutory period unless the original complaining party informs Hitnews that it has filed a court action seeking to restrain the subscriber from engaging in the allegedly infringing activity.

Any restoration of material or access will be handled in accordance with applicable law and subject to Hitnews's technical ability to restore or re-enable the relevant material.

9. Repeat Infringer Policy

In accordance with the DMCA, Hitnews maintains and reasonably implements a policy providing for the termination, in appropriate circumstances, of subscribers or account holders who are repeat copyright infringers.

Hitnews may consider relevant circumstances when determining whether action is appropriate, including the nature and frequency of infringement notices, whether notices appear valid, counter notifications, court determinations and other relevant information.

Hitnews reserves the right to suspend or terminate accounts for serious copyright violations where permitted or required by applicable law and the Hitnews Terms of Use.

10. Fair Use and Other Authorized Uses

Copyright law permits certain uses of copyrighted works without permission from the copyright owner, including circumstances that may qualify as fair use under United States law.

Hitnews does not determine whether every particular use of copyrighted material constitutes fair use or another legally authorized use.

A person submitting a DMCA notice is responsible for having a good-faith belief that the complained-of use is not authorized by the copyright owner, its agent, or the law.

11. Misrepresentation

Under 17 U.S.C. Section 512(f), a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages and other consequences provided by law.

You should therefore carefully consider whether the material is actually infringing before submitting a DMCA notice or counter notification.

13. Relationship to Other Hitnews Policies

Use of Hitnews is also governed by the Hitnews Terms of Use, Hitnews Acceptable Use Policy and Hitnews Privacy Policy.

Violation of copyright law may also constitute a violation of the Hitnews Terms of Use or Acceptable Use Policy.

14. Changes to This Policy

Hitnews may update this DMCA and Copyright Policy from time to time to reflect changes in applicable law, its services, technical infrastructure or procedures. The current version will be published on the Hitnews website together with the date of the latest update.
