Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs the use of Hitnews services and forms part of the Hitnews Terms of Use. Hitnews is operated by RSP Sales Inc., 963 Street Road, Southampton, PA 18966, United States.

1. Purpose and Scope

This Policy is intended to protect the reliability, security, integrity and lawful use of the Hitnews service and its infrastructure. By using Hitnews, you agree to comply with this Policy, the Hitnews Terms of Use and all applicable laws and regulations.

2. Authorized Use

Hitnews accounts may be used only within the scope and usage limits of the subscription purchased. Individual subscriptions are intended for the personal use of the account holder. If Hitnews offers a subscription that permits use by multiple persons, such as a Family plan, use is permitted only in accordance with the limits and conditions applicable to that plan.

Accounts may not be commercially resold, made publicly available, sublicensed or shared with unauthorized users.

3. Fair Use Policy

Plans described as "Unlimited" are subject to this Fair Use Policy. Unless different limits are expressly stated for a particular subscription, usage is limited to a maximum of 5 TB in any 24-hour period and a maximum of 40 TB in a calendar month.

These limits are intended to prevent exceptional or abusive consumption from adversely affecting the service, network capacity or other users. Hitnews may temporarily restrict or suspend access when these limits are exceeded.

Hitnews may update reasonable Fair Use limits when necessary to protect service quality or infrastructure. Material changes will be communicated or published as required by applicable law.

4. Prohibited Activities

You may not use Hitnews to engage in unlawful, fraudulent, abusive or harmful activity. Prohibited activities include, without limitation:

• Violating applicable laws or regulations.
• Uploading, posting, transmitting or distributing content in a manner that infringes copyrights, trademarks or other intellectual property rights.
• Obtaining, distributing or making available child sexual abuse material or other content whose possession or distribution is prohibited by law.
• Engaging in fraud, phishing, identity theft or other deceptive conduct.
• Distributing malware, viruses, ransomware or other harmful software.
• Attempting to gain unauthorized access to systems, servers, accounts, devices or networks.
• Interfering with, attacking or disrupting Hitnews systems, Usenet infrastructure or third-party systems.
• Sending spam or unsolicited bulk communications.
• Circumventing technical restrictions, security controls, usage limits or other protective measures.
• Using automated or other methods in a manner that unreasonably degrades or disrupts the service.

5. Spam and Abuse

Hitnews may not be used to distribute spam, unsolicited bulk messages, fraudulent communications or other abusive traffic. Users must comply with applicable anti-spam and electronic communications laws.

Hitnews may investigate credible abuse reports and take appropriate action where the activity is associated with systems operated or controlled by Hitnews.

6. Copyright and Intellectual Property

Users are responsible for respecting the copyrights and other intellectual property rights of third parties. The fact that content is technically accessible through Usenet does not mean that a user has permission to download, copy, upload, post, transmit or distribute it.

You may not use Hitnews to upload, post or distribute material in a manner that infringes the intellectual property rights of others. Copyright complaints are handled in accordance with the Hitnews DMCA and Copyright Policy.

7. Network and Security Abuse

Users may not probe, scan, attack, overload, compromise or attempt to circumvent the security of Hitnews systems or third-party systems. Activities that threaten the stability, availability or security of the service are prohibited.

Hitnews may take immediate protective measures when necessary to protect users, systems, infrastructure or third parties.

8. Account Sharing and Reselling

Accounts may be used only as permitted by the applicable subscription. The use of different IP addresses does not by itself constitute a violation of this Policy.

Unauthorized sharing, public distribution of login credentials, commercial resale of access, or simultaneous use beyond the limits of the applicable plan is prohibited.

9. Enforcement

Hitnews may restrict, suspend or terminate access when there is a reasonable basis to believe that a user has violated this Policy, the Terms of Use, applicable law or applicable subscription limits.

Depending on the circumstances, Hitnews may issue a warning or provide an opportunity to correct a violation. Hitnews may act immediately and without prior notice in cases involving serious abuse, illegal activity, fraud, security threats, repeated violations or circumstances requiring urgent action.

Any refund or credit following suspension or termination is governed by the Hitnews Terms of Use and applicable law.

10. Abuse Reports

Suspected abuse involving Hitnews may be reported to support@hitnews.com.

Please provide sufficient information to identify the activity, including relevant message identifiers, headers, timestamps or other technical details where available.

Hitnews can generally take direct action regarding abusive or unlawful posts only where the relevant activity originated through systems operated or controlled by Hitnews. Content originating from an independent third-party Usenet provider may need to be reported to the originating provider.

11. Changes to This Policy

Hitnews may update this Policy from time to time to reflect changes in its services, infrastructure, security requirements, business practices or applicable law. The current version will be published on the Hitnews website with the date of the latest update.

Where required by applicable law, Hitnews will provide additional notice of material changes.
